太原富力天禧城B区涉嫌违规售卖人防车位

太原富力天禧城B区涉嫌违规售卖人防车位
人防工程属于国防资产，依法配建的人防车位所有权归属国家，按照山西省、太原市现行规定，人防车位只租不售。近日，太原市尖草坪区汇丰街道小东流社区富力天禧城B 区业主反映，小区地下车库内存在公开售卖人防车位现象。经走访核实后向太原市政务热线12345求证，确认该行为涉嫌违反现行管理规定。知名房企富力地产旗下项目再度爆出违规争议，其多重失信、处罚记录也引发业主广泛担忧。
在太原市尖草坪区汇丰街道小东流社区富力天禧城B 区地下车库实地调查发现，车库多处墙面、立柱张贴车位销售宣传，宣传中明确对外售卖地下车位，并预留联系电话。随即拨打了宣传上的联系人员进行核实，对方证实所推销车位有人防区域车位，可以直接买卖，主要是地下一层和二层人防车位，目前已经有售出去的，价格不等，大概4万元左右。
为厘清行为合规性，又致电太原市政务服务热线12345咨询相关政策。工作人员明确答复：开发商只有平时使用权、收益权，没有所有权；人防车位无法办理不动产权证书，人防车位严禁公开出售。
依据晋建房规字〔2023〕35 号《房地产开发项目车位和车库租售管理办法》，该文件自 2023 年 3 月 27 日起在山西全省统一实施，太原市严格遵照执行。文件第十二条明文规定：建筑区划内依法配建的人民防空工程范围内规划用于停放汽车的车位、车库不得出售，只能出租给本小区业主、物业使用人，单次租赁期限最长不得超过 20 年；租赁期满，双方方可协商续租。
人防车位依附防空地下室建设，属于国家国防资产。开发商仅享有人防工程平时使用权、收益权，不具备所有权，无权进行所有权买卖。市面上开发商惯用的“永久使用权转让”“一次性买断 70 年使用权” 等模式，本质上属于变相出售人防车位，超出 20 年期限的约定不受法律保护。战时，人防工程政府可依法无偿征用，购买车位的业主权益无法保障。
据此，太原富力天禧城B 区公开售卖人防车位的行为，明显与省级文件、太原市人防管理要求相悖，属于违规行为。
违规出售人防车位，企业需要承担哪些法律责任？根据晋建房规字〔2023〕35 号第二十一条，建设单位违规出售不符合出售条件车位车库，住建主管部门可责令限期整改，对企业信用评价扣分，记入房地产开发企业诚信档案。
同时，依据《中华人民共和国人民防空法》相关条款，侵占、违规处置人防工程，人防主管部门可给予警告、责令限期改正，视情节处以罚款；市场监管部门可针对虚假宣传、误导消费者行为开展查处。
开发商与购房者签订的人防车位买卖协议，因违反强制性管理规定，存在被法院认定合同无效的风险。购房者有权起诉要求解除协议、退还全部购车位款项。一旦房企资金出现风险，业主预付资金将面临巨大损失。
通过天眼查查询了解到，开发富力天禧城项目的为太原富润房地产开发有限公司隶属于富力地产。该企业经营状态虽为存续，但已被列为失信被执行人、被执行人，背负大量司法纠纷与行政处罚记录。此前，富力旗下“富力天禧公馆” 项目曾因消防违法违规，累计被处以 192 万元罚款。多重不良记录叠加此次涉嫌违规售卖人防车位事件，不少小区业主表示顾虑重重，担心自身合法权益难以保障。
小区业主告诉记者，不少业主起初并不清楚人防车位和产权车位的区别，看到车库售卖广告，差点花钱购置。业主呼吁相关监管部门尽快介入调查富力天禧城B 区违规售卖人防车位问题，责令开发商停止违法行为，清理车库内违规销售广告，妥善处置已经签订车位买卖协议的业主诉求。

在此提醒广大太原市民：区分产权车位与人防车位。产权车位可正常交易、办理不动产权证；人防车库设置人防密闭门、人防防护标识，不动产登记中心无法办理产权证。购买车位前，务必要求开发商出示规划图纸核实车位属性，切勿高价购买人防车位。如发现开发商违规售卖人防车位，可向太原市住建局、市国防动员办公室（人防办）、市场监督管理局投诉举报。
